Booking Terms & Conditions

1.Interpretation

1.1. These Bookings Terms and Conditions form a contract between C&S EVENTS LTD (t/a The Venue on Middle St.) and the Client whereby C&S EVENTS LTD grants the Client access to the premises for the staging of the Event (‘this Agreement’)


2.Booking and Payment

2.1. All bookings must be confirmed via signature to confirm agreement to adhere to the Booking Terms & Conditions. The person who signs the document shall be considered the Client. When a booking is made on behalf of an organisation, the person signing warrants that he/she is authorised to commit the organisation to this Agreement and shall be jointly and severally liable in respect of the booking with the organisation.

2.2.Client responsibilities

2.2.1. The Client shall be held responsible for the safety of any equipment brought onto the premises and for any damage caused to C&S EVENTS LTD's property by any such equipment.

2.2.2. The Client shall be responsible for appointing, paying and supervising all Contractors/Suppliers that they bring onto the premises to facilitate their event. Any equipment brought into the premises must be taken away again at the end of the event, unless otherwise agreed in writing with C&S EVENTS LTD.

2.2.3. The Client will ensure that any necessary licences, permissions or approvals in relation to the Event are obtained and that copies of any such documents are provided to C&S EVENTS LTD more than 14 (fourteen) days before the Event.

2.2.4. The client will ensure that no permanent or temporary objects are driven into any part of the premises without the prior written consent of C&S EVENTS LTD; no display posters, boards, signs, flags or other emblems or advertisements inside or outside any part of the premises without the prior written consent of C&S EVENTS LTD.

2.2.5. The Client will take good care and not cause any damage to be done to the premises or to any fittings, equipment or other property in the premises. Where damage is caused by any act, omission or neglect of the Client or their guests, the Client is expected to make good by paying for the damage. The decision of repair or replacement will be determined by C&S EVENTS LTD. C&S EVENTS LTD will select the tradesmen or supplying company and will provide estimate of works to be carried out/replacement and will issue a copy of the estimate and an invoice for this amount to repair/replace the damaged area/items which will be due for immediate payment.

2.2.6. The Client will not at any time publish or cause or allow to be published any comment or material likely in the reasonable opinion of C&S EVENTS LTD to discredit or damage C&S EVENTS LTD's reputation.

2.2.7. The Client will ensure that the conduct of the Event does not cause any nuisance or offence to other persons or guests either visiting or working in the premises; and at the end of the Hire Period the Client will remove all the Client’s goods and hand back the Hire Area cleared and in such condition as it was in before the Hire Period. In default the Client shall pay C&S EVENTS LTD the Clearance Fee during which the default exists and shall indemnify C&S EVENTS LTD against any costs, damages or liability incurred by C&S EVENTS LTD as a result of such default.

2.3. The Client shall not allow the number of people in the Hire Area at any time to exceed the Maximum Capacity for that floor(s)

2.4.The benefit of this Agreement is personal to the Client and not assignable or capable of being sub-licensed to any other party.

2.5.Additional charges:

2.5.1. Should C&S EVENTS LTD agree to vary the Services, Equipment or Hire Period either before or during the event, C&S EVENTS LTD reserves the right to increase the Fee in respect of any agreed changes.

2.5.2. Where the hire fee is calculated in part or in full with reference to the number of guests if the number of guests that attend the event is lower than the number of guests specified in the agreement, the full Hire Fee remains payable. If the number of guests that attend the event is higher than the number of guests specified in this agreement, then an additional fee shall be charged based on the fee per guest.

2.5.3. Changes to the booking which incur additional charges as outlined in sections 2.4 above will be charged via Invoice and liable for payment on receipt of the invoice. If the changes are made on the day of the event, these charges will be due for payment immediately.

2.6.Hire Fee and Deposits

2.6.1. The Client will pay the Fee to C&S EVENTS LTD as follows: Bookings are confirmed once the initial part-payment has been received by C&S EVENTS LTD and the Terms & Conditions are electronically signed by the Client and submitted. For bookings with a £0 minimum spend the part-payment required to secure the booking is 50% of the total Hire Fee. The remaining 50% of the Hire Fee falls due 2 weeks before the event date. For bookings with a minimum bar spend element, the part-payment required to secure the booking is 12.5% of the agreed minimum bar spend. A further 12.5% of the agreed minimum bar spend falls due 2 weeks before the event date. For events with a minimum bar spend element, the amount paid will be fully refunded as long as the agreed minimum bar spend is met or exceeded.

2.6.2 Charges for Catering, Welcome Drinks and Drinks Tokens

Should any catering, welcome drinks or drinks tokens be required by The Client, these items must be paid for in full at least 14 days in advance of the event. In the event of cancellation this amount is entirely non-refundable. 

2.6.3. If the Client fails to pay all or any part of the amounts due to C&S EVENTS LTD under this Agreement by the due date for payment, C&S EVENTS LTD reserves the right to cancel the booking. In this instance all amounts paid to date would be non-refundable.

2.6.4. All prices quoted are inclusive of applicable VAT at the prevailing rate.

2.6.5. C&S EVENTS LTD reserves the right to alter prices or other details without notice.


3.Cancellation

3.1. Should the Client cancel all or part of the booking by written notice prior to the beginning of the Hire Period, C&S EVENTS LTD shall charge the following fees:


For events with a Hire Fee only / £0 Minimum Bar Spend:

Within 7 days of booking the event: £0*

More than 112 days prior to the event: 25% of the total Hire Fee

15 - 112 days prior to the event: 

50% of the total Hire Fee

0 - 14 days prior to the event: 

100% of the total Hire Fee


Postponement Options:

We do not allow postponement of dates for any events on our Standard Terms. If a client wishes to postpone their event the above cancellation charges would apply


*If the event date is within 14 days of the booking date then fee defaults to 100% of the total Hire Fee)


For events with a £0 Hire Fee and a Minimum Bar Spend element:

Within 7 days of booking the event: £0*

More than 112 days prior to the event: 12.5% of the agreed Minimum Bar Spend

15 - 112 days prior to the event: 

25% of the agreed Minimum Bar Spend

0 - 14 days prior to the event: 

50% of the agreed Minimum Bar Spend


Postponement Options:

We do not allow postponement of dates for any events on our Standard Terms. If a client wishes to postpone their event the above cancellation charges would apply


*If the event date is within 14 days of the booking date then fee defaults to 25% of the agreed Minimum Bar Spend)


Flexi-Terms are also available for an additional charge, the details of which can be provided upon request.


3.2. For frequent periodic hire agreements if the payment is not received in accordance with 2.5 above, this will result in immediate cancellation of the remaining hire period

3.3. In the event that C&S EVENTS LTD is prevented from carrying out all it’s obligations by circumstances beyond their reasonable control, including government intervention, strikes, labour disputes, accidents, acts of God, national or local disasters, war or any event causing the whole or a substantial part of the premises to be closed to the public, breakdown of equipment, failure of third party suppliers, the Company’s liability will be no greater than the amount already paid by the Client to C&S EVENTS LTD in respect of services booked.


4.Limitation of Liability

4.1. C&S EVENTS LTD shall not be responsible for any loss or damage to the property arising out of the holding of a function or any injury which may be incurred by or be done by or happen to any person during the holding of a function arising from any cause whatsoever, or for any loss due to breakdown of machinery, failure or supply of electricity or telephone, leakage of water, fire, riot, government restriction or act of God which may cause the premises to be temporarily closed or the function interrupted.

4.2. C&S EVENTS LTD's liability whether under this Agreement or otherwise, shall be limited to the Total Fee or such part of it as has been paid at any time. C&S EVENTS LTD will not be liable for the death of or injury to any person except where such death injury or loss is due to the negligence of C&S EVENTS LTD, its servants or agents.

4.3. In the event of conflict between these Booking Terms and Conditions and the Special Terms, the Special Terms shall prevail. The terms of this Agreement may be varied by written agreement between the parties signed by the authorised representatives of both parties. You will need to provide your own public liability insurance for your event.


5. Services at the venue

5.1 All alcoholic drinks are supplied in house by C&S EVENTS LTD. No outside drinks are to be brought into the premises unless it has been agreed by the management in writing prior to your event taking place.

5.2 C&S EVENTS LTD has a licensed bar and provides a range of alcoholic drinks. The bar is provided as part of bookings for live music, parties and other celebration events.  

5.3 If your event goes to the end of our licensed hours, the management will close the bar 15 minutes before the end of your event and request that all music is stopped 15 minutes after the bar is closed. All guests must have left the premises 30 minutes after the bar is closed.

5.4 Any person that appears to be under the age of 25 will be asked to provide approved ID should they wish to be served alcohol. The Management or security at C&S EVENTS LTD reserve the right to refuse entry without giving reason if they feel it necessary to do so in line with the Door Policy.


6.Under 21s

6.1 Under 21s are welcome at The Venue but the following policy applies and forms part of these Terms & Conditions:

7.Emergency Evacuation

The Hirer is required to have reviewed the Emergency Evacuation Plan and agrees to assume responsibility for the safe evacuation of their guests in the event of fire or emergency. C&S EVENTS LTD staff are regularly trained in the Emergency Evacuation Plan and so will provide assistance in the event of an emergency. STANDARD & FLEXI TERMS COMPARISON

For a small fee clients can purchase a Flexi Terms 'add-on'.  This offers enhanced flexibility around cancellation and postponement options which are not available on our Standard Terms.

MINIMUM SPEND TERMS & CONDITIONS

If you have opted for our Minimum Spend Agreement (as opposed to paying a Hire Fee), the following terms will apply to your booking in additon to the standard Terms & Conditions.


In opting for a Minimum Spend Agreement, you are guaranteeing a minimum amount of money will be spent on the night, by both yourself and your guests.  Drinks bought on the night by you and your guests will count towards this amount, as will any food and drinks you order from the venue ahead of the event.   

Should the total spend not meet the required minimum, you will be charged for the shortfall.

To book your event we require a deposit to the value of 25% of the agreed minimum spend.  At this time we will additionally place an authorisation on your card for the total agreed minimum spend (less deposit paid).   


If the minimum spend has been met/exceeded, we will refund the deposit in full.  If the minimum spend has not been met, we will deduct the shortfall from your deposit and take any further shortfall from your card.  At this point the authorisation will be released.  These transactions will be processed on the next working day after your event and any refunds can take up to 10 days to appear in your account.
